Terms of Usage

This Agreement contains the complete terms and conditions which govern your subscription of Web hosting and other related services provided by Hostingsouk.com.

Upon signing up for Hostingsouk.com services, all customers agree to comply with our Terms of Service. The spirit of this policy is to ensure our customers are using Hostingsouk’s services with due regard to the rights of other Internet users and in conformity with the requirements of our network environment.

1. Illegal Use

Our hosting plan may be used for lawful purposes only. Transmission, storage or distribution of any information, data or material in violation of any applicable law or regulation, or that may directly facilitate the violation of any particular law or regulation, is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of unacceptable content or links include: pirated software, hacker programs or archives, Warez sites, MP3, and IRC bots.

2. Security

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include but are not limited to the following: unauthorized access, use, probing, or scanning of systems security or authentication measures, data, or traffic; interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

3. Server Resources

Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given the option to pay additional fees (which will depend on the resources required), reduce the resources used to an acceptable level, or upgrade its service to a professional plan. WE shall be the sole arbiter of what is considered to be a high server usage level. Any web hosting account deemed to be adversely affecting server performance or network integrity will be shut down without prior notice.

4. Banned Scripts

We do not allow scripts that require more than 8Mb of memory space, more than 30 CPU seconds, or use more than 5% of all available system resources at any time.

We do not allow running stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD, Any software that interfaces with an IRC (Internet Relay Chat) network.

We do not allow IRC, egg drop bots or anything of the sort on our network. IRC servers are subject to DOS Attacks The ports necessary to make IRC work are filtered. If you are caught running an IRC server inside our network your account will be terminated. This is a pretty common practice in the hosting market today.

We do not allow following scripts with known security issue. Ultimate BBS (all versions), Ikonboard (all versions), IRC Egg Drops, Proxy Servers, nph-proxy, The Anonymizer, any soap mailers, CGI-telnet or script that opens a shell session with the server.

6. UCE (Unsolicited Commerce Email)

Zero Tolerance Spam Policy: We take a zero tolerance stance against sending of unsolicited e-mail, commonly known as spam. Any user who sends out spam will have their account terminated without notice, if reseller is sending spam; all his accounts will be suspended. We charge $100 for spamming instance as clean up charge.

7. Server Abuse

Any attempts to undermine or cause harm to our server or customer are strictly prohibited and any customers attempting this will be terminated with out notice.

8. Service Availability

We shall use our reasonable endeavors to make available to you at all times the Server and the Services but we shall not, in any event, be liable for interruptions of Service or down-time of the Server. No more than one log-in session under any one account may be used at any time by you.

9. Server Outages/Moves

If for any reason we have to move your account from one type of server from another we will make sure you have all of the features on the new server except we reserve the right to not provide the same scripting solutions or database solutions.

10. Termination

The failure by a customer to meet or follow any of the above Terms of Use or fail to pay any sums due to us is grounds for account deactivation. We will be the sole arbiter as to what constitutes a violation of the Terms of Use. We reserve the right to suspend/remove any account without prior notice.

11. ARBITRATION AND CONCILIATION

All disputes arise related to this site (hostingsouk.com) are resolved under the provisions of THE ARBITRATION AND CONCILIATION ACT, 1996. Hostingsouk.com has sole authority to appoint arbitrator and fix the place of arbitration.
